Epic Games faces significant legal challenges as the Federal Trade Commission (FTC) responds to its use of dark patterns—deceptive design tactics aimed at tricking users into making unintended purchases. The aftermath has led to a landmark settlement of $245 million, with $72 million already refunded to affected Fortnite players.
Dark patterns are calculated manipulations within user interfaces, designed specifically to initiate confusion and pressure among consumers. Epic Games has been accused of employing tactics such as inconsistent button placements that make it all too easy for players to make unwanted payments. Even simple actions, such as waking the game from sleep mode or previewing an item, often led to accidental acquisitions. Notably, these deceptive practices have adversely affected teenagers and children, as identified by the FTC.
FTC Chair Lina M. Khan stated the seriousness of these infractions: ‘Epic used privacy-invasive default settings and deceptive interfaces to trick Fortnite users. Protecting the public, especially children, from online privacy invasions and dark patterns is a top priority for the Commission.’
This week, the FTC commenced the process of refunding players, distributing over 629,000 payments via PayPal and checks, with an average refund amounting to $114, illustrating the extent of the financial repercussions on users. Nevertheless, these actions against Epic Games signal more than just reimbursement; they are part of a wider initiative to combat dark patterns in digital environments.
Coined by designer Harry Brignull in 2010, dark patterns have emerged as a pervasive challenge on the internet, coercing consumers into financial transactions or data disclosures that they might not typically consent to. Research indicates that these manipulative strategies are alarmingly effective, often doubling or tripling conversion rates with minimal consumer backlash.
As dark patterns become increasingly widespread, the FTC’s measures against Epic Games serve as a stern warning to other companies employing similar deceptive strategies. With regulatory agencies embracing a stricter stance, we may be on the cusp of enhanced oversight of these manipulative online practices.
